Your Rights When Responding to Police Questions

"When you are approached by the police during an investigation, regardless of your age, although you are required to provide identification or identifying information, such as your name and date of birth, you are under no obligation to answer any further questions.If presented with this situation always remember the following: "I will not answer any questions without the presence of my attorney. Attorney Fremgen joined the firm of Kindt Phillips Friedman & Fremgen, S.C. (formerly known as Yakes, Bauer, Kindt & Phillips, S.C.), in June of 2004. Prior to that, Mark was a solo practitioner for 3 ½ years with the Fremgen Law Offices. From 1990 to 2000, he was an Assistant State Public Defender assigned to the Oshkosh office.

Although Mark offers a wide range of services, from divorces to personal injury, he has concentrated his practice in criminal and traffic defense. Since 1990 Mark has handled over 3,000 criminal cases, including first-degree homicide, sexual assault, domestic disorderly conduct, battery, theft and other criminal offenses. Mark has had over 100 trials over the last 14 years, including two homicide trials. His experience in criminal defense includes: felony offenses, misdemeanors, domestic offenses, OWI (DUI, DWI) offenses, juvenile matters and probation/parole revocation hearings.

Attorney Fremgen has been previously appointed to various judicial and legislative committees. In 1995 he was appointed to the Governor’s task force on revising the OWI and OAR laws in Wisconsin. As a result of that committee, the OAR and OAS laws of Wisconsin were drastically changed. In 1997, Mark was appointed to the 4th Judicial District’s committee on vehicle forfeiture laws to address how the courts were to deal with requests to forfeit a vehicle related to a repeat criminal drunk driving conviction. In 2000, Mark was appointed to the 4th Judicial District’s committee to develop sentencing guidelines for OAR/OAS convictions. Guidelines that are currently in place and used by the Courts in this district.

Since 1996, Mark has provided the Winnebago County Bar with the annual review of criminal law cases at the Associations monthly bar meeting and has been involved in presenting county CLE programs. Each year Mark provides to the county’s attorneys a summary of the previous years criminal law rulings from the US Supreme Court, Wisconsin Supreme Court and Court of Appeals, as well as pertinent legislation. In addition, Mark coordinates the Winnebago County Criminal Defense Bar’s monthly meetings to discuss topical criminal law issues in Winnebago County.
